Terms of Service

1. Acceptance of Terms

By accessing or using Tracabit ("Service"), provided by Tracabit Inc. ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.

2. Use of the Service

Tracabit grants you a non-exclusive, non-transferable right to access and use the Service in accordance with your subscription plan. You agree to use the Service exclusively for lawful purposes and in compliance with all applicable data privacy and telecommunications regulations.

3. Accounts, Security & API Keys

You are responsible for maintaining the confidentiality of your ingestion API keys, bearer tokens, and account credentials. You agree to notify us immediately of any unauthorized use or security compromise of your keys.

4. Data Ownership & Privacy

You retain all right, title, and interest in and to all telemetry data submitted to your tenant instance. Tracabit processes data strictly in accordance with our Privacy Policy and executed Data Processing Agreement (DPA).

5. Acceptable Use Policy

You agree not to deliberately submit raw Personally Identifiable Information (PII), such as plaintext credit card numbers, passwords, social security numbers, or medical records, in custom event payload properties.

6. Service Availability & SLAs

We strive for continuous edge availability. Our Service Level Agreements are defined as follows:

• Free Starter Tier: Provided "as-is" without financial uptime guarantees.
• Pro Tier: 99.5% monthly uptime SLA.
• Enterprise Dedicated / VPC: 99.99% monthly uptime SLA backed by dedicated edge infrastructure.

7. Payment, Usage & Billing

Paid plans are billed monthly or annually in advance based on your committed event tiers. Metered overage is billed at standard published rates ($12 per 1,000,000 additional events). Failure to pay may result in suspension of ingestion endpoints.

8. Termination

You may terminate your account at any time via the Project Settings dashboard. Upon termination, all active ingestion keys will be immediately revoked, and your tenant data will be permanently purged in accordance with our automated retention schedule.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Tracabit Inc. be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
